Applies to: https://www.themathpal.com, https://quiz.themathpal.com, and any related mobile or web apps and services operated by TheMathPal ("TheMathPal," "we," "our," or "us").
Plain‑English summary (non‑binding): These Terms are the rules for using TheMathPal. By creating an account or using our site/app, you agree to them. Please also review our Privacy Policy. If you’re a parent/guardian, you’re responsible for your child’s use. If you’re a school, separate school terms or a data processing addendum may apply.

1) Acceptance of Terms
By accessing or using the Services, you agree to be bound by these Terms and any policies referenced here (including our Privacy Policy). If you do not agree, do not use the Services.
If you are accepting on behalf of a minor, a school, or an organization, you represent that you have authority to bind that person or entity.
2) Eligibility & Child Safety (COPPA/Minor Users)

The Services are intended for students and families. If you are under 13 (or the age of digital consent in your country), you may use the Services only with the verifiable consent of a parent or legal guardian, who must supervise your use and manage your account settings.

Parents/guardians agree to be responsible for a minor’s activity on the Services, including purchases and communications.

If we learn that a child has used the Services without required consent, we may suspend or delete the account.
3) Accounts & Sign‑In (including Google Sign‑In)

You may sign in using Google or other methods we make available. You agree to provide accurate information and keep your account secure.

You are responsible for all activity on your account. Notify us promptly of any unauthorized use.

We may refuse, suspend, or terminate accounts for policy violations, suspected fraud, or risk to users.
4) Educational Content; No Professional Advice
The Services provide educational content, practice problems, quizzes, and tutoring features. While we strive for accuracy, we do not guarantee that all content is correct or suitable for your needs. Educational materials are not professional academic, financial, legal, or medical advice.
5) Subscriptions, Payments, Credits, and Refunds
Some features may require payment (for example, subscriptions, quiz credits, or tutoring sessions). When you purchase, you agree to the pricing and terms shown at checkout.

Billing & Auto‑renewal: If you purchase a recurring plan, it will renew automatically at the then‑current price unless you cancel before renewal. You can cancel at any time in your account settings; the plan remains active through the end of your current billing period.

Refunds: Except where stated at purchase or where required by law, fees are non‑refundable. If we materially fail to provide the paid Service you purchased, contact us within 30 days and we will work with you in good faith to fix the issue or provide a reasonable pro‑rata credit or refund.

Trials/Promotions: If offered, the special terms shown with the offer apply. We may modify or discontinue offers at any time.
If your organization (e.g., a school) has a separate written agreement, that agreement governs to the extent of any conflict.
6) Acceptable Use
You agree not to:

Violate laws or the rights of others;

Upload harmful code, attempt to hack, probe, or disrupt our systems;

Circumvent access controls, rate limits, or payment requirements;

Misrepresent your identity, impersonate others, or harvest personal data;

Post or transmit content that is illegal, harassing, hateful, or sexually explicit;

Use the Services to train competing models or datasets without our written permission;

Use automated tools to scrape content except as permitted by robots.txt or a written agreement.
We may remove content or suspend access for violations.
7) User Content & License
You may submit content (e.g., answers, messages, files, feedback). You retain ownership of your content. You grant TheMathPal a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, display, and create derivative works of your content solely to operate, improve, and provide the Services.
You represent you have the necessary rights to submit content and that your content does not infringe any third‑party rights.
8) Intellectual Property; TheMathPal Content
All software, features, quizzes, and instructional materials we provide are protected by IP laws. Except for the rights expressly granted to you to use the Services, we reserve all rights. You may not copy, modify, sell, or distribute our content or software unless we say so in writing.
9) Use of AI Features and Limitations
The Services may include AI‑generated explanations, hints, or content. AI features may occasionally produce errors or incomplete information. Use independent judgment and cross‑check important results. Do not rely on AI outputs for decisions with significant consequences without human review.
10) Third‑Party Services (e.g., Google)
We integrate with third‑party services (such as Google Sign‑In). Your use of those features may be subject to the third party’s terms and privacy policies. We are not responsible for third‑party services.
11) Schools, Teachers, and Student Data
If you are a school or teacher using the Services with students, you represent that you have obtained all required consents and authorizations, and you agree to use the Services in compliance with applicable student privacy laws (e.g., COPPA in the U.S.). We can provide a separate data processing addendum upon request for school/enterprise use.
12) Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect users or our Services. Upon termination, sections that by their nature should survive (e.g., IP, disclaimers, limitation of liability) will survive.
13) Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT CONTENT WILL ALWAYS BE ACCURATE OR COMPLETE.
This disclaimer does not limit any statutory rights you may have and does not exclude liability that cannot be excluded under applicable law.
14) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THEMATHPAL AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES.
IN ALL CASES, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) US$100 OR (B) THE AMOUNTS YOU PAID TO US FOR THE SERVICES DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY.
The above limits do not apply to liability for death or personal injury caused by negligence, fraud, willful misconduct, or any liability that cannot be excluded or limited by law.
15) Indemnification
You agree to indemnify and hold TheMathPal harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
16) Export & Sanctions
You may not use or export the Services in violation of U.S. export laws and regulations or applicable sanctions programs.
17) Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of California, U.S.A., without regard to conflict‑of‑law principles.
Venue: Except where prohibited by law, you and TheMathPal agree to the exclusive jurisdiction and venue of the state and federal courts located in California, U.S.A. You and TheMathPal each waive any objection to venue or inconvenience of forum in those courts. If the laws of your jurisdiction give you the right to bring claims in your local courts (for example, as a consumer), nothing in these Terms limits that right.
Informal resolution: Before filing a formal claim, please contact us. We will try to resolve the dispute in good faith within 30 days.
18) Changes to the Services or Terms
We may update the Services and these Terms from time to time. If changes are material, we will provide reasonable advance notice (for example, by posting on the site or emailing the address associated with your account). Changes take effect when posted unless a later date is stated. If a change materially reduces your paid plan’s features during a paid term, you may cancel and request a pro‑rata refund for the unused portion of that term.

20) Miscellaneous

Entire agreement: These Terms, together with any policies referenced, constitute the entire agreement between you and TheMathPal.

Severability: If any provision is unenforceable, the rest remain in effect.

Assignment: You may not assign these Terms. We may assign them in connection with a merger, acquisition, or transfer of assets.

No waiver: Our failure to enforce a provision is not a waiver.
